3. Property Information & Disclosure

  • Marketing Materials: All brochures, websites, advertisements, and promotional materials are for informational purposes only. They represent the intended project design and specifications at the time of publication but are not legally binding. Dimensions, layouts, specifications, visuals, and amenities are subject to change based on regulatory approvals, technical requirements, and force majeure events. Final details will be as per the Agreement for Sale.

  • Images and Renderings: Computer-generated images, artist’s impressions, photographs, and walkthroughs are conceptual and indicative only. They do not constitute a warranty or representation of the final product. Actual finishes, furnishings, landscaping, and views may vary.

4. Booking and Payment

  • Booking Process: A booking is considered formalized only upon the execution of a written Agreement for Sale and the receipt of the stipulated booking amount.

  • Payment Schedule: All payments must be made strictly as per the payment plan outlined in the Agreement for Sale. Delays in payment may attract interest charges as specified in the agreement.

  • Mode of Payment: Payments should be made via cheque, bank transfer, or other methods specified by Ashoka Developer and drawn in favor of the entity mentioned in the agreement.

5. Project Development & Timelines

  • Timely Delivery: While Ashoka Developer is dedicated to timely project execution, the completion date is an estimate. The company shall not be liable for delays caused by factors beyond its reasonable control, including but not limited to acts of God, war, civil commotion, strikes, lockouts, delays in securing statutory approvals, or shortages of materials.

  • Changes and Modifications: Ashoka Developer reserves the right to make necessary modifications to the building plans, specifications, amenities, and infrastructure to comply with government regulations, technical requirements, or to enhance the project, without prior notice.

6. Title and Ownership
Ashoka Developer warrants that it has clear and marketable title to the land on which the project is being developed. All necessary approvals and sanctions from relevant authorities will be obtained and maintained throughout the project’s development.

7. Customer’s Responsibilities

  • The customer is responsible for providing accurate and complete information required for documentation.

  • The customer must review all documents, including the Agreement for Sale, meticulously before signing.

  • The customer is responsible for ensuring timely payments as per the schedule.

8. Cancellation and Refund Policy
Cancellation by the customer must be submitted in writing. The refund policy, including any applicable cancellation charges, will be strictly governed by the terms laid out in the Agreement for Sale.

9. Force Majeure
Ashoka Developer shall not be held responsible for any failure or delay in performing its obligations due to events beyond its reasonable control (Force Majeure), including natural disasters, fire, war, terrorism, government actions, pandemics, or major strikes.

10. Governing Law and Jurisdiction
These Terms and Conditions, and any agreements entered into with Ashoka Developer, shall be governed by and construed in accordance with the laws of India. Any legal disputes shall be subject to the exclusive jurisdiction of the courts located in [City, State, e.g., Gurugram, Haryana].
